近日鄭秀玲教授、賴中強律師及邱文聰先生等三人提出「關鍵產業衝擊報告」，對於服貿協議在銀行業的相關質疑，為避免以訛傳訛，金管會今天公開回應說明。

有關「兩岸銀行規模不對等，中資將取得經營權，改變我銀行業市場版圖的問題」，金管會表示，陸銀來台最高參股比率是，金控100%持股的子銀行可達20%，這樣的比率，中資無法取得經營權。

「有關兩岸銀行風險一體化問題」，金管會表示，該報告關切重點為大陸已成為我國銀行業的最大債務人，兩岸銀行風險一體化，金融危機容易擴散蔓延。實際上，目前對銀行大陸投資、授信等均訂有上限，並訂有總曝險上限一倍規定，目前比率為0.62倍，尚在合理水準。

金管會已督導銀行做好風險控管，且監控銀行業的總體風險情形，相應採行必要管理措施，尚無兩岸銀行風險一體化問題。

回應反黑箱服貿的訴求，金管會上午連發2則聲明稿，除了說明學生占領立法院，讓台股市值蒸發逾新台幣5000億元，並且針對台大經濟系教授鄭秀玲對金融衝擊的質疑，予以回應。

對於反服貿抗議逐漸擴散，金融監督管理委員會連續發出2則聲明稿回應。金管會除了擔憂，服務貿易協議抗議事件衝擊台股，讓投資人有損失之外，也針對鄭秀玲所提出的「關鍵產業衝擊報告」中，針對銀行業提出 4項質疑，逐一解釋。

針對兩岸銀行規模不對等，陸資將取得經營權，金管會強調，最高為參股比重是金控下持股100%的子銀行，陸資可達20%，但陸資無法取得經營權。

對於大陸是銀行最大債務國，兩岸銀行風險一體化，金管會回應，不論銀行投資大陸、放款等都有控管，整體來說，目前也僅是淨值的0.62倍，尚屬於合理範圍。

客戶信用資料的保護問題，金管會說，已嚴格限制陸銀查詢聯徵資料。

有關台灣金融監理主權弱化問題。金管會表示，透過兩岸監理合作平台，讓金管會可掌握本國銀行在大陸分行的營運狀況，且促進銀行業健全穩定發展，是強化台灣的金融監理。

行政院長江宜樺今天表示，化解外界對服貿的疑慮，與在野黨交換意見的可能性，政府從來都不排除，「府院都是如此」。他說，如果能以說明、座談會方式舉行最好，「如果是辯論也歡迎」。

江宜樺說，如有中立的媒體舉辦，邀請在野黨領袖如蘇貞昌、蔡英文等辯論，「包括馬總統、吳副總統及我，乃至相關部會首長，都會願意接受檢驗」。

金管會中午一連發布兩份新聞稿，其中一份是針對學者、律師等人的說法，提出說明及澄清。

金管會說，最近台大經濟系教授鄭秀玲、律師賴中強，以及邱文聰先生等人提出的「關鍵產業衝擊報告」，金管會從「經營權」、「銀行風險」、「信用資料」，以及「金融監理權」等4個層面說明。

一、兩岸銀行規模不對等，中資恐取得經營權，改變台灣銀行業市場版圖。

該報告指出，放寬陸資參股比率，將取得我國銀行業經營權。

金管會解釋，一定會在兼顧我國不同類型金融機構經營權穩定的前提下，以差異化方式，適度提高陸銀參股投資的法定限額（持股最高為20%，且為金控下子銀行）。

也就是說，中資無法取得經營權。而且，陸銀參股可強化被參股銀行資本，陸銀申請參股也須報經金管會等單位核准，因此，提高陸銀參股比率不會影響金融機構經營權及國內金融市場穩定。

二、 有關兩岸銀行風險一體化。

該報告指出，大陸已成為我國銀行業最大債務人，兩岸銀行風險一體化，金融危機易擴散蔓延。

金管會解釋，為控管我國銀行對大陸地區曝險，設下多道限額，包括：國銀在大陸的投資金額（含營業資金），不可超過淨值15%、金控則不可超過淨值10%、國銀的第三地和OBU對大陸授信，不可超過資產淨值30%。

對大陸地區授信、投資及資金拆存總額，不可超過前一年度的一倍；截至今（2014）年1月，為0.62倍，處合理水準。

三、 有關客戶信用資料的保護。

該報告指出，陸銀參股國銀，開放銀聯公司來台，以及金融業委外在大陸設立離岸客服中心等有信用資料保護問題。

金管會解釋，陸銀參股，取得董事席次，也不能以董事身分查詢聯徵資料；銀行的聯徵資料，也不能提供給參股銀行或策略夥伴。另外，銀聯日後來台，無法發卡或授信，因此，並無法申請成為聯徵中心會員。

四、 有關台灣金融監理主權弱化問題

該報告指出，日後雙方主管機關規定衝突時，將弱化我國金融監理主權。

金管會解釋，目前已有「兩岸銀行監理合作平台」，透過平台，可與陸方溝通相關監理事宜，強化金融監理。
