請問斡旋書的有效期間?

各位前輩們好.

小弟是個買屋新手, 想請教版上的各位前輩有關“斡旋書（不動產買賣意願書）”幾個問題.

小弟前陣子於 103/03/10 簽了斡旋, 斡旋期間到 103/03/23.

然後房仲在03/16晚上口頭上跟小弟說房子成交了,

但03/18開始跟房仲鬧了有點不愉快,

所以到了今日(103/03/31)都還沒簽正式的不動產買賣契約書.

我想請問各位前輩們, 那這張斡旋書還有效嗎？

因它上面寫“買方與賣方應於轉定之日起五日內簽訂不動產買賣契約書.
若買方之承買價款及本意願書之條款於斡旋有效期間內不爲賣方所接受,或期滿後不同意繼續斡旋,
則本意願書自動失效”

小弟也沒有在該房仲口頭告知後五日內與賣方簽約,

小弟沒有打算不買, 但現已不太信任該房仲, 打算找別的房仲,

這樣小弟可以說這張斡旋書已經失效了嗎？還是有其他的方法呢？

煩請各位前輩指點迷津, 謝謝.

ps: 1. 小弟下斡旋時, 該名房仲也沒有拿“不動產現況說明書”給小弟簽名確認.
