如果你是停在停車格或白線，那不會有責任；黃線的話，代表也是容許停車的區域，頂多超時被罰緩。

汽車臨時停車時，應依下列規定：
1.橋樑、隧道、圓環、障礙物對面、鐵路平交道、人行道、行人穿越道、快車道等處，不得臨時停車。
2.交岔路口、公共汽車招呼站十公尺內、消防栓、消防車出入口五公尺內不得臨時停車。
3.設有禁止臨時停車標誌、標線處不得臨時停車。
4.道路交通標誌前不得臨時停車。
5.不得併排臨時停車。
6.臨時停車時，應依車輛順行方向緊靠道路右側，但單行道應緊靠路邊停車。其右側前後輪胎外側距離緣石或路面邊緣不得逾60公分，但大型車不得逾1公尺，在單行道左側臨時停車時，比照辦理。

如果你有違反上面任何一項，那就代表你是停在不該停車的地方，那就一定會有責任。

你車損人安，頂多告對方財損(民法)，但對方人摔傷，是有權利告你過失傷害的(刑法)，若你確定有責任，那這種情節的結局都是和解(汽車賠機車)了事。

你自己評估看看吧，停在不該停的地方有人撞了上來只能說倒楣，但如果是機車，各自負責通常已經是最好的結果，因為你站著，他躺著。
