少女「裝熟」做愛　男子無辜被告不起訴

新竹縣一名23歲鍾姓男子，因和一名15歲未成年少女交往並發生性關係，而被少女父親怒告性侵；不過，全案經檢方偵結後，卻認為鍾男屬「過失而非故意」，因此予以不起訴處分。

根據了解，鍾男在到案後表示，自己並沒有對少女性侵，是少女自願和他發生性關係，而且少女還向他表示，已經滿18歲，直到接到少女父親電話，才知道原來少女只有15歲，事後少女才坦承是高一學生。

庭訊時，少女則證稱，是因為怕鍾男不愛她，會叫父母把她載回家，所以才刻意隱瞞實際年齡。

全案經檢方偵結後，認為少女外表成熟，應對能力非常世故，的確很難從外表判定其實際年齡；因此認定，鍾男在不知情的狀況下與少女發生性關係，屬過失而非故意，不符合《刑法》「明知」的要件，予以不起訴處分。
