有錢喝酒買彩券 要扶養費遭駁回

蔡姓男子提民事訴訟，要求2名兒子要付他扶養費，他說離婚後獨自生活，後來工作受傷，只能靠拾荒維生，兒子已成年應扶養他。2名兒子說，從小由母親扶養，父親從未盡到扶養義務，現在卻要他們扶養父親並不公平。

台中地院法官駁回蔡的要求，法官認為，蔡的兒子提供老屋給蔡住，蔡每周會買3次彩券，每月和朋友相約在汽車旅館相聚喝酒，這些都非必要消費，可見他未達「不能維持生活」條件。
