北市張姓男子2011年12月隨團到大陸四川旅遊，同月9日下峨嵋山時昏倒猝死，家屬向富邦人壽申請旅遊意外險理賠500萬元。富邦指意外死亡是指外來的、突發的故事致死，張非意外事故致死，拒賠。

一審判富邦勝訴；二審指出張家人提健保就醫紀錄證明他甚少就醫，健體健康；旅行團領隊作證，張沒有搭刺激的交通工具如快艇、大魔神等遊樂器材，可見張猝死原因應屬外來、突發而不可預見的意外傷害，符合保險契約規定，改判富邦敗訴應理賠500萬元。

富邦再上訴，今天被最高法院駁回，全案定讞。
