台灣高等法院駁回前總統陳水扁保外就醫聲明異議案，高院指出，否准扁聲請保外就醫的機關是法務部，而不是執行刑罰的檢察官，屬於「監獄行刑」範圍；陳水扁保外醫治的審核、是否許可，屬於法務部行政處分，他若不服法務部的決定，應循行政訴訟救濟。
