新竹縣20歲從事粗工的莊男，去年8月因李姓友人與彭男爭風吃醋，雙方發生鬥毆，莊竟在過程中將李的情敵彭男，從頂樓踢下樓，彭送醫後仍不治，莊男因此依殺人罪嫌遭判刑12年。彭男的雙親也向莊男提出損害賠償，要求賠償醫療、喪葬、扶養費、精神慰撫金等費用，新竹地方法院審理後，判處莊男須賠償約562萬元。
