華廈新電梯使用權

我們家住一棟7層一層一戶的華廈且沒有管委會

因為電梯已經30幾年了需要換新的

3F到7F全部都同意分擔新電梯的費用

唯有2樓主張不常用到電梯所以不願出新電梯的費用

並說如果換新電梯他可以不使用

想請問如果我們其他樓層達成協議換新電梯也都同意不讓電梯停靠2樓

且如果2樓屋主也同意並簽下永不使用電梯的切結書

這有法律上的效力嗎? 之後如果她房子轉賣這個切結書對新屋主還有效嗎?

那如果2樓屋主不願簽切結僅口頭承諾但事後反悔了這樣我們站得住腳嗎?
