羅瑩雪：反服貿無法構成「公民不服從」

針對反服貿群眾運動，有人主張「公民不服從」是阻卻違法的事由，檢察官不應該蒐證。法務部長羅瑩雪今天(15日)視察台東地檢署時表示，服貿協議尚未立法審查，「反服貿」無法構成公民不服從條件。

羅瑩雪說，「公民不服從」是對政府一些法律或措施侵犯人民的權利，人民才可用拒絕服從的方式來表示意見，但是服貿協議都還沒經過立法院審查，所以無法構成公民不服從的條件。她說，世界各國「公民不服從」的例子，都是提出的人承認自己違法，也接受法律的處罰‧她強調，法律有界線，勇於衝撞就要負起責任。

另外，羅瑩雪強調，所有的偵查都要蒐證，並不是偵查就將所有的人都當作被告，一定要還原事實才能依法處裡，許多不起訴案件，也都是偵查的結果。（照片：吳鳳雪攝）
