學運幹部應訊 檢方訊後請回

（中央社記者劉世怡台北21日電）反服貿學生代表林飛帆等7人今天主動向北檢說明，檢方召集多名檢察官同步開庭，訊後將7人請回。律師顧立雄說，為7人做無罪答辯。

台北市警察局原訂今天下午4時在台北巿保安大隊約談林飛帆等21人，不過林飛帆等7人下午1時40分在多名律師陪同下赴台北地檢署，向檢察官主動說明318占領立法院與323占領行政院的始末。

318公民覺醒運動義務律師顧立雄表示，黃國昌、林飛帆、陳為廷、魏揚、黃郁芬、黃守達及周馥儀7人不接受警方約談，直接到台北地檢署主動向檢方說明。

檢方召集多名檢察官同步開庭，經訊問約1小時後，將7人請回。檢方表示，林飛帆、陳為廷等人日前就遭民眾告發妨害公務等罪，也已經分案，今天就以被告身分訊問他們，其陳述內容若超過被告發的案件範圍，檢方會視為自首，至於黃郁芬等人在檢方並沒有案件，則認定自首到案說明並受理偵辦。

顧立雄在庭訊後表示，有向檢方請求之後就由檢察官直接來偵辦，不要透過警局約談；今天被訊問的7人有依照承諾，向檢察官表示，願意承擔也會配合檢察官相關的偵查動作，不會逃避應承擔的法律責任。

顧立雄說，7人是基於憲法層次上的抵抗權以及公民不服從來從事這一場學運，如果有其他參與學運者也遭警方約談，可以直接與司改會聯絡，律師團會幫忙。

記者提問，今天算不算自首，有無請求檢方從輕發落（量刑）？顧立雄表示，檢方如果認為主動到案說明，構成自首的要件，這是對被告有利的，律師團不會反對；但律師團的基本立場是這一場學運，相關延伸的法律責任，會從無罪角度去答辯。
