殺女友 刀鋒戰士逃過謀殺罪

自由時報 – 〔編譯魏國金／綜合報導〕南非法官11日裁定，由於檢方無法證明去年情人節槍殺女友的「刀鋒戰士」皮斯托里斯（Oscar Pistorius）蓄意犯案，因此所有謀殺罪指控皆不成立。不過，法官也認為他有「疏失」，仍將繼續接受過失殺人罪的審判。
還要面對過失殺人審判
66歲的普勒托利亞高等法院法官馬希帕（Thokozile Masipa）說，證據顯示皮斯托里斯真的相信他的女友瑞娃．史蒂坎（Reeva Steenkamp）仍在臥室，而在浴室裡的人是小偷。27歲的皮斯托里斯在聆聽法官宣判時淚流滿面。若謀殺罪成立，他將面臨終生監禁，在取得假釋前將入獄至少25年。
馬希帕在駁回謀殺罪指控前，質疑皮斯托里斯為何對浴室「開了4槍而非1槍」，但她認為開槍未必表示他有蓄意殺人之心。她也質疑證人的證詞，表示她相信媒體報導影響證詞，且證人在案發時處於半夢半醒之間，證詞可靠性令人懷疑：「科技要比人的感知與記憶可靠。」
馬希帕說，被害人的傷勢使她「立刻失能」，因此證人深夜聽到的尖叫聲並非來自史蒂坎，而是皮斯托里斯，他開了槍，然後因意識到可能誤殺女友而尖叫。
皮斯托里斯去年2月14日情人節，以手槍擊斃他交往半年的史蒂坎。檢方以謀殺罪及其他3項與武器有關的罪名起訴他。儘管馬希帕表示檢方提出的事證不足以說服她皮斯托里斯蓄意殺人，但她也認為皮斯托里斯當時除了開槍外，還可以採取其他行動，例如報警或呼叫住家保全。若法官判他過失殺人或誤殺罪名成立，刑期最高可達15年。
