陳姓男子3年前騎機車行經新北市環堤大道，因車道有雜草泥沙而摔車遭輾斃。最高法院判決新北市政府應賠新台幣245萬元定讞。

法院判決指出，正值壯年的陳男在民國100年1月間騎車行經新北市蘆洲區的環堤大道，他想超越同向的大貨車，但因車道上有雜草和泥沙，煞車偏滑而當場倒地，遭大貨車輾過休克死亡。

陳男父母主張，新北市政府養工處疏於管理環堤大道，導致雜草侵入路道，且車道上留有泥沙，導致陳男車禍身亡，因此訴請國賠245萬餘元。新北市政府養工處則主張，陳男想超車又未保持安全車距而肇事。

台灣高等法院參照現場勘驗照片，認定該路段車道旁的雜草高度達到成年男子肩膀，還侵入路肩且超越路邊紅線，污泥也污染車道，新北市政府養工處疏於管理，與車禍發生有因果關係，應負起7成過失責任，應賠償陳男父母245萬餘元，陳男應自負3成責任。案經最高法院駁回上訴定讞。(中央社)
