【更新】房祖名被批捕　中國律師：緩刑可能性小

房祖名日前在北京吸毒遭刑事拘留，今天被以涉嫌容留他人吸毒罪，遭北京市東城區檢察院批捕。
 
中國最高人民檢察院官方微博公布，9月10日，北京市公安局東城分局以陳祖明（房祖名本名）涉嫌容留他人吸毒罪，提請北京市東城區檢察院審查批捕，於9月17日通過，公安機關將對此案繼續偵查。
 
據中國《刑法》第354條規定：「容留他人吸食、注射毒品的，處三年以下有期徒刑、拘役或者管制，並處罰金。」房祖名容留他人在其暫住地吸食毒品，已構成容留他人吸毒罪。

而據房祖名住處繳獲110逾克大麻、坦承8年前首次吸毒等情節，中國《新京報》報導，北京藍鵬律師事務所的龐理鵬律師分析認為，雖然房祖名認罪態度良好，但不足以判處緩刑，因為他不存在自首情節，且吸毒時間較長，多次聚眾吸毒；除非有重大立功表現，才可能會判緩刑。（娛樂中心／綜合報導）
