車禍害孕婦流產 男判2月

（中央社記者廖壬楷台中17日電）江姓男子去年駕車與騎機車的詹姓少年發生碰撞，導致機車衝進路邊早餐店，造成早餐店老闆娘受驚流產，今天被法院判刑2月。

台中地方法院判決書指出，江姓男子去年駕駛小客車，行經交岔路口時貿然左轉，與無照騎乘機車的詹姓少年發生碰撞，導致詹姓少年的機車失控衝進路邊的早餐店內。

機車除撞壞店內桌椅、設備及器具外，還造成彭姓店員腦震盪、髖挫傷與腹壁挫傷等傷害，而懷孕4週的張姓老闆娘也因遭受驚嚇，3天後大量出血至醫院檢查，才發現已經流產。

江姓男子庭訊時辯稱，張姓老闆娘流產與車禍發生間並無相關因果關係。但婦產科醫師證稱，張姓老闆娘懷孕4週，突然遭遇此劇烈、突然車禍，必將受極大驚嚇，導致懷孕出現不穩定甚至流產的後果。

法官認為，張姓老闆娘流產與經歷車禍遭受驚嚇有相當因果關係。且江姓男子犯後否認犯行，又未能與被害人達成和解，依過失傷害罪判處江男有期徒刑2個月，得易科罰金，全案可上訴。1030917
