打疫苗預防皮蛇　疑違法醫療廣告

最近電視頻繁播映由藝人林美秀代言的「預防皮蛇」廣告，政大法律系副教授劉宏恩昨在臉書公開檢舉，這是明目張膽的違法醫療廣告，衛福部選擇性執法、抓小放大。

今日出版的《自由時報》報導，林美秀在廣告中提醒50歲以上成人，皮蛇（帶狀疱疹）很常見，除鼓勵民眾撥打電話諮詢，也提醒可打疫苗預防。目前國內只有一家藥廠生產皮蛇疫苗，廣告是否以「衛教廣告」的形式偷渡「藥品廣告」？食藥署副署長姜郁美指出，疫苗視為須經醫師處方的處方藥，僅限於學術性醫療刊物刊登廣告；若只是呼籲大家要施打疫苗，並未指涉特定產品，仍屬衛教宣導。劉宏恩指，這是明顯「宣傳醫療業務，以求招徠患者」的「醫療廣告」。（方翊倩／綜合報導）
