鄭怡信涉弊交保 遭高院撤銷

基隆市月眉路拓寬工程傳弊端，18名市議員涉案被約談，其中鄭怡信遭檢方聲押，二十一號獲院方裁定交保。檢方提出抗告，台灣高等法院今天將原裁定撤銷，發回基隆地院。

高院在撤銷發回的理由中指出，法院訊問後如果認為犯罪嫌疑不足或沒有羈押理由時，應駁回檢方羈押的聲請，如果認為有羈押的理由，而無羈押必要時，再命具保、責付或限制住居代替，原裁定既然認為檢方聲押無理由而駁回，則受審查的客體已因駁回而不存在，結果卻裁定以五十萬元交保代替羈押處分，顯然紊亂無羈押原因及無羈押必要性的區別，所以將原裁定撤銷發回重裁。
