[求助] 財產交易所得稅的問題

我們是二親等間買賣房屋.
買屋時代書因故用贈予的方式辦理, 免贈與稅, 他說過戶原因寫的是買賣, 叫我們用公告現值報財產交易所得稅即可.

賣屋後看到大家的討論, 想改用實價補申報, 卻發現國稅局早已結案認為這是贈予.
贈予承辦人員解釋代書是為了不想提出資金證明, 所以用贈予的方式辦理.
財產交易稅承辦人員則說, 我們提出合約書, 貸款與轉帳證明, 可以認可為實質買賣, 非贈予.
但是若有人檢舉, 還是有可能翻船.

所謂的檢舉指的是甚麼呢? 只要我們確實是買賣, 就不用擔心嗎?

茲事體大, 當時代書只說用贈予的比較方便, 不會讓我們多繳一毛稅.
現在看了大家的討論才知道這會造成持有成本變成公告現值
賣屋買屋價差不大, 實價申報與用公告現值申報財產交易所得稅, 金額差不多, 想說去補報沒差.
現在卻因為代書處理的方式造成我們有了虛假的超大額收入.
只能躲嗎?
