油氣外洩貶值房地產 加油站賠361萬

桃園某加油站的油氣洩漏、汙染地下水，與附近19戶住家發生糾紛，公害糾紛裁決會裁決，加油站應賠償住戶水費7萬多元、房地市價貶損361萬元；加油站只肯賠水費，提告確認房價貶損的損害賠償請求權不存在。

一審法院判加油站敗訴，全案上訴二審，台灣高等法院審理認為，加油站產生汙染雖沒有造成房地物理性損害，但一般交易市場上，仍因心理因素影響，使交易價格貶損；桃園縣府雖解除該處地下水汙染列管，但解除管制僅數月，房地交易價格受影響不會立即消失，判加油站敗訴，加油站應賠償住戶。
